Solicitation Policy: Any non-profit associations and/or group must have any solicitation activity pre-approved prior to participating in the farmers’ markets. Therefore any attempt at an oral or written request, offer, or enticement, or action which indicates the availability to provide services for compensation or which seeks to purchase or secure services or goods; the purchase or sales of goods; a request for money or other property or a contribution of money or other property is strictly forbidden without prior written permission. Agreement: I agree to distribute only materials that have received prior approval by CFMA for educational purposes only. I will not solicit (see policy above) or resell products at the market without prior written permission. I agree to operate by the CFMA market rules and regulations. I agree to cooperate with the market management, and provide the market manager a copy of my current nonprofit tax ID. Rules and Regulations are available at www.CAfarmersmkts.com or by mail if you do not have access to the internet. I/We hereby agree, as a Non-Profit Representative at a CFMA’s certified farmers’ market, that I/we will I ndemnify and hold harmless the sponsors of the market site, the CFMA, their agents and employees, from and against any and all liability, claims, demands, expenses, fees, fines, penalties, suits, proceedings, actions and causes of action of any and every kind and nature arising or growing out of or in any way connected with my/ our use or occupancy as a Non-Profit Representative at a CFMA farmers’ market. I hereby agree as a Non-Profit Representative in the CFMA farmers’ markets that I will maintain vehicle liability insurance for the vehicle used that market day, and where applicable, and worker’s compensation insurance, in effect while I am a participating in any CFMA farmers’ market. I hereby agree and understand that my participation at the farmers’ markets is on an space available basis and the renewal of my selling privileges is based upon the following factors: consistent reserved attendance, cooperation with the market manager, positive consumer relations, positive relations with the market manager, cooperation of my business and its sales representatives, quality of products, adherence to the market rules and regulations. I will not utilize distributorships or commission to compensate for the sales of my products. I hereby declare that I have the authority to sign this acknowledgement/agreement as the participant owner or the participant owner’s representative. By signing this acknowledgement/agreement, I acknowledge that a representative(s) of CFMA is hereby given permission to visit the location(s) where my product(s) is/are produced and/or stored to verify compliance with the CFMA 2017 Market Rules and Regulations and the State of California’s regulations. I also agree that I and/or my firm is not a distributorship. I agree that any dispute that arises between myself and the CFMA or between the participating business and the CFMA and any other person(s) and /or entity(ies) related to the participation in CFMA markets shall be resolved by the process outlined in the CFMA 2017 Market Rules and Regulations.
