BLOOMINGDALE PARK DISTRICT REFEREE INDEPENDENT CONTRACTOR AGREEMENT I. It is the intention of the (Bloomingdale Park District) (hereafter, Park District), to create a nonexclusive Independent Contractor Relationship with the Referee, (hereafter referred to as “Referee”) for officiating services for the soccer league for the 2013 season. A. B. C. D. Referee acknowledges and agrees that Referee is not entitled to any benefits or protections afforded employees of the Park District or bound by any obligations of employees of the Park District. Referee understands and fully agrees that Referee will not be covered under provisions of the unemployment compensation insurance of the Park District or the workers’ compensation insurance of the Park District and that any injury or property damage on the job will be Referee’s sole responsibility and not the Park District’s. Also, it is understood that Referee is not protected as an employee or as a person acting as an agent or employee under the provisions of the general liability insurance of the Park District and therefore, Referee will be solely responsible for Referee’s own actions. It is the intention of the parties to create a non-exclusive independent contractor relationship. Referee may engage in other business activities and provide similar services to other entities and business. Referee agrees not to hold him/herself out as an employee or joint employee of the Park District to members of the public. Referee acknowledges and agrees that Referee is solely responsible to pay all applicable federal, state and local income and withholding tax obligations or contributions imposed by social security, unemployment insurance and worker’s compensation insurance on behalf of Referee. II. Park District has contracted with the Referee for the purpose of officiating league games (and playoffs) as assigned by Park District for the 2013 season. Referee shall maintain all applicable certifications and/or licenses, and shall comply with all rules and regulations applicable to the officiating and conduct of league games. A copy of all league rules and regulations will be provided to the Referee prior to the start of the season. III. Referee shall at all times have sole control over the manner, means and methods of performing the services required by this agreement according to Referee’s own independent judgment. IV. A. B. C. D. The 2013 fee for each assigned game shall be $20-40 per game depending on age level of games being officiated. Referee shall be properly attired and shall report to the assigned playing sight fifteen (15) minutes prior to game time. Referee is expected to begin a game immediately upon his/her arrival in the event s/he has arrived late. If Referee arrives 30 minutes or more late, then only one-half (1/2) of the contracted fee will be given as compensation. Any canceled or postponed game will be paid in full unless 24-hour advance notice is given. In the event the Referee fails to arrive for an assigned game, the Park District will not submit payment for that game. E. The Park District will report payments to an individual of $600 or more to the IRS on Form 1099Misc. Referee will provide to the Park District a Social Security Number or Federal Employer Identification Number for any individual receiving payment. V. Referee acknowledges and agrees that Referee is responsible for all expenses, including the provision of equipment and materials related to provision of the contracted for results, unless otherwise agreed to between the parties. VI. Referee will comply with all applicable facility, park district, local, state and/or federal laws, rules and regulations. Referee is further expected to encourage fair play and sportsmanship. VII. The Park District may terminate this contractual agreement in the event of contract breach. Referee shall have financial responsibility to the Park District for reasonable costs incurred by the Park District including the cost of obtaining replacement services. VIII. This Contract constitutes the entire agreement between the Parties pertaining to the subject matter hereof and supersedes all prior or contemporaneous agreements and understandings either oral or written of the Parties in connection therewith. No modification of this Contract shall be effective unless made in writing, signed by both Parties and dated after the date hereof. This Contract is non-assignable by Referee and shall automatically expire at the end of the 2013 season.
