Vetting of Contract
1. (a) The employer is required to draw up a contract of employment in writing and submit
for vetting and approval to the Ministry of Labour, Industrial Relations and
Employment before the worker leaves his country.
(b) The set of contract to be submitted for new workers must be as follows:(i) 4 copies in English + 2 copies in chinese for workers coming from China;
(ii) 4 copies in English for workers coming from India;
(iii) 3 copies in French for workers coming from Malagasy Republic;
(iv) 3 copies in English for workers coming from other countries.
( c ) The set of contract of employment in case of renewal must be only in three
copies in the aforesaid English/French language. Copy in Chinese language is not
required.
(d) In case more than one worker is being imported from a country, the employer is
not required to submit individual set of contracts for each worker but submit one
single set with a list of workers including their names,passport no., address in their
country of origin and their date of Birth.

There is no need to vet the contract of employment if the basic salary is in excess of Rs
360,000 per annum.

The contract of employment should at least contain the following information and
provisions:
The Ministry of Labour and Industrial Relations ensures that the contract of employment
contains the following information and provisions.
(i)
Name of parties bound by the contract of employment ;
(ii)
Nationality of worker/passport number;
(iii)
Duration of contract;
(iv)
Sector of employment/category of worker;
(v)
Basic salary;
(vi)
Hours of work ( 5-day week or 6-day week);
(vii)
Tea breaks and meal break;
(viii) Payment of attendance bonus (wherever applicable in law);
(ix)
Keeping of attendance/wages book;
(x)
Issue of payslips on payment of wages;
(xi)
Annual leave, sick leave/prolonged illness;
(xii)
Refund of outstanding leaves;
(xiii) Paid Public Holidays;
(xiv)
End of Year Bonus;
(xv)
Provision of air ticket on termination of employment;
(xvi)
Traveling/free transportation from place of residence to place of work and back;
(xvii) Provisions of protective equipment;
(xviii) Free accommodation with water supply, electricity and cooking gas;
(xix)
Food/subsistence allowance;
(xx)
Workmen’s compensation insurance;
(xxi)
Repatriation in case of death, ill health or family reasons;
(xxii) Notice of termination of employment and termination of employment;
(xxiii) Disciplinary procedures.
